3. Get Your Business Featured

Submitting a “Get Your Business Featured” form is an initial enquiry only.

A submission does not automatically mean that Business Spotlight has agreed to create or publish a spotlight.

Every submission may be reviewed to determine whether it is suitable for Business Spotlight.

We may contact you for additional information before confirming a project.

Any agreed services, pricing, production requirements, publication arrangements or other commercial terms may be confirmed separately in writing.

4. Information and Materials You Provide

You are responsible for ensuring that information and materials you provide to us are accurate and that you have the necessary rights, permissions and authority to provide them.

This may include:

  • Business information
  • Logos
  • Images
  • Videos
  • Product information
  • Event information
  • Written content
  • Brand assets
  • Other materials supplied for production

You must not provide materials that unlawfully infringe another person’s copyright, trademark, privacy rights, publicity rights or other legal rights.

5. Content Creation and AI Production

Business Spotlight may use artificial intelligence, digital production tools, editing software and other technologies to create or assist with spotlight content.

AI-generated or AI-assisted content may require human review, editing and refinement.

While we aim to produce content that accurately reflects the information provided to us, you remain responsible for confirming that business-specific facts, claims, names, prices, dates and other material details relating to your business are accurate before publication.

6. Approval and Publication

Where approval is requested, you are responsible for reviewing the final content and notifying us of material factual errors or requested corrections within the agreed review period.

Once content has been approved or otherwise authorised for publication, it may be published through Business Spotlight channels and agreed social media platforms.

Unless otherwise agreed in writing, publication timing and placement may vary.

7. Your Content and Permission to Use It

You retain ownership of the business materials you provide to us unless otherwise agreed.

By providing materials for an agreed Business Spotlight project, you grant Business Spotlight permission to use, reproduce, edit, adapt and display those materials as reasonably necessary to create, publish and promote the agreed spotlight content.

This permission may include use on the Business Spotlight website, social media channels and other agreed promotional channels.

8. Intellectual Property

The Business Spotlight website, branding, logos, design, original copy, graphics, production systems and other original materials created by Business Spotlight remain the property of Business Spotlight or its licensors unless otherwise agreed in writing.

You must not copy, reproduce, modify, distribute or commercially exploit our website content, branding or proprietary materials without permission.

Ownership and permitted use of a specific completed spotlight or other deliverable may be determined by the applicable project agreement.

9. Fees and Payment

Where paid services are offered, pricing, payment schedules, deposits, production fees and any applicable cancellation or refund terms will be communicated separately before the relevant service is confirmed.

You are responsible for paying agreed fees by the applicable due date.

Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law.

10. Cancellation and Changes

Once production has commenced, cancellation or changes to a project may affect production timelines and fees depending on the work already completed and the agreed project terms.

Any project-specific cancellation, rescheduling or refund arrangements will be governed by the applicable written agreement or quotation.

11. Accuracy of Business Claims

You are responsible for ensuring that claims made about your business, products or services are accurate, lawful and appropriately supported.

You must not ask Business Spotlight to create content that is misleading, deceptive, unlawful or likely to breach applicable advertising or consumer protection laws.

Business Spotlight may decline to create or publish content that it reasonably considers inappropriate, unlawful, misleading, offensive or inconsistent with its brand or editorial standards.

12. Third-Party Platforms

Spotlight content may be published or distributed through third-party platforms such as Instagram and other social media services.

Those platforms operate independently and may change their features, algorithms, policies, availability or content rules.

Business Spotlight is not responsible for changes, restrictions, removals, outages or decisions made by third-party platforms.

13. Website Availability

We aim to keep the website available and functional, but we do not guarantee that it will always be uninterrupted, error-free or available.

We may temporarily suspend or modify the website for maintenance, security, updates or other operational reasons.

14. Limitation of Liability

To the extent permitted by law, Business Spotlight is not responsible for loss arising from circumstances outside our reasonable control, including third-party platform changes, internet outages, hosting failures, technical interruptions or unauthorised third-party actions.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Where the Australian Consumer Law applies, our services come with guarantees that cannot be excluded under that law. For major failures with a service, you may have rights including cancellation of the service contract and a refund for the unused portion or compensation for reduced value, as well as compensation for other reasonably foreseeable loss or damage.
